TENANT GUIDE (Documents U should have)






Looking for property to rent? Where to rent? How do I do it? 


I am no expert but having been in the real estate industry as a Senior Real Estate negotiator for 4+ years now, I do have some tips to share on real estate. There will be a series on Landlord guide, Tenant guide, or relevant information on real estate in Malaysia. Follow me on my blog if you want to know more. (Note : All contents shared are my personal observations & experiences,  without prejudice to my rights).


Check list on documents you should have:

  • TENANCY AGREEMENT ~~~ You should initiate to have a tenancy agreement. This can be done by the agent or mutually agreed between yourself and landlord. The agreement should be in writing, acknowledged by landlord and yourself and a witness that witnessed the signing. If you want to legalise the agreement, have it stamped at the income tax office nearest to you. Your landlord and yourself should have a copy each. The tenancy agreement consists of two parts :
  • Part A : The terms of the agreement which states what your landlord and you agreed to do during the duration of tenancy. Example : Details of Landlord & your (Name, IC, Current Correspondence Address, Contact number and Email Address) Rental per month, deposits, effective date & termination date, etc.
  • Part B : consists of obligations & onus of both landlord and tenant. Example, landlord to pay for maintenance, quit rent, etc. Tenant liable to pay for all utilities example, Electricity (Tenaga Nasional), Water, Wi-Fi/Broadband, cable TV (ASTRO), etc.
  • INVENTORY LIST ~~~ Go through thoroughly with the agent or landlord on all the items provided in the premise. Make sure both parties acknowledge on the copies & date the copy for future reference when you move out. (one each for tenant and landlord). This is to avoid disputes later on.
  • IF YOU ARE A FOREIGNER ~~~ Do be prepared, as you may need to furnish the following documents :
  • Photocopies of passport of all residents staying in the premises.
  • Photocopies of working permits and visas of tenant or/ and all residents
  • Photocopy of offer letter from the company that employs you
  • IF YOU ARE LOCAL ~~~ Copy of IC
  • IF STAYING IN CONDO (MANAGEMENT OFFICE) ~~~ Advisable to give management office (if condo) a copy of the tenancy agreement. Also to furnish them with residents' details. This is relevant and important during any emergency or should there be any evacuation due to natural disaster, fire, etc. At the least, management would know if they have evacuated all their residents. Make sure to leave current mobile numbers & update them as and when you change mobile numbers or fixed line numbers.
  • NO. OF PARKING BAYS ~~~ Most condos will provide car stickers. To get it, management office would require the tenancy agreement as proof. In the event, agreement is still at stamping office, please ask landlord to apply on your behalf.
